In comparing these two paths, an EB-1A lawyer focuses on this: EB-1A asks whether you personally are already at the top of your field and have sustained national or international acclaim, while EB-2 NIW asks whether the endeavor you will pursue is important to the United States and whether you are well positioned to carry it out. If your evidence of achievement is strong enough, EB-1A may be worth evaluating, and its visa backlog is currently shorter. If your achievements are still building but your career plan is clear, NIW may be more realistic. Neither requires employer sponsorship. The information below is current as of November 6, 2026.
Key differences
| Item | EB-1A | EB-2 NIW |
|---|---|---|
| Core of the review | Personal extraordinary ability | National importance of the endeavor and your qualifications |
| Basic threshold | A major international prize, or at least 3 of 10 criteria | An advanced degree or exceptional ability, plus the three Dhanasar prongs |
| Final determination | The overall evidence must show you are among the small percentage at the very top of your field | On balance, waiving the job offer would benefit the United States |
| Degree requirement | No fixed degree requirement | Must meet the EB-2 degree or exceptional ability requirements |
| Premium processing target time frame | 15 business days | 45 business days |
| Final Action Date for China-born applicants | August 1, 2023 | October 1, 2021 |
Dates are taken from the November 2026 Visa Bulletin and may change each month. The Dates for Filing chart shows different dates, and which chart applies each month is whatever USCIS announces. In most other regions, EB-1 is currently without a visa backlog, and EB-2 is April 1, 2025.
The Form I-140 fee is the same for both: $715 on paper or $665 online, plus a $300 Asylum Program Fee for self-petitioners. The premium processing fee is $2,965, which affects only processing speed and not the review standard.
What to look at when choosing
EB-1A has two hurdles. The first asks whether the evidence objectively meets the criteria, such as awards, association memberships, media coverage, judging the work of others, original contributions, scholarly articles, critical roles and high pay. The second looks at the overall evidence. Meeting 3 criteria does not mean passing, because the officer will also decide whether you are already at the top of your field and whether your acclaim is sustained.
NIW does not require you to already be renowned, but it demands a lot on exactly what you will do. A vague description of the endeavor that shows no national-level impact is a problem to avoid in this kind of petition. For an explanation of the three prongs, see Who qualifies for NIW.
A rough first assessment might go like this:
- If you can show outside recognition independent of yourself and your employer, such as peer review in the field, major awards or media attention, evaluate EB-1A first.
- If your degree and experience fit EB-2 and you have a clear project and plan, but your outside recognition is limited, evaluate NIW first.
- If you need a path with employer support, you may also consider EB-1B, EB-1C, or EB-2 and EB-3 through PERM.
Note that EB-1, EB-2 and EB-3 should not all be called "extraordinary ability." EB-1A is the extraordinary ability category within them.
What to prepare
- Resume, degrees and employment records.
- Awards, papers and citations, patents, judging records, media coverage and proof of pay.
- A specific plan for future work in the U.S.
- Independent recommendation letters supported by facts. USCIS stresses that recommendation letters carry weight only when backed by evidence.
Beginning in August 2026, when initial evidence is missing, an officer may deny a petition without first issuing a request for evidence, so it is not advisable to file in a hurry when the evidence is insufficient.
Who should review this
Each path involves trade-offs, so we suggest laying out your evidence item by item and comparing, rather than choosing a category first. Whether it is an EB-1A lawyer, EB-2 lawyer or EB-1 lawyer, the evaluation should focus on the evidence and the timeline. Different U.S. immigration lawyers may reach different judgments, and you can ask them to explain their reasoning.
