NIW immigration lawyer: who qualifies for a national interest waiver

Lu Xin Law Offices · November 6, 2026 · Applies to U.S. federal immigration matters

An NIW immigration lawyer decides whether a national interest waiver suits you mainly by looking at three points: that you already meet EB-2 eligibility, that you have a specific endeavor of national importance to the United States, and that you can show you are in a position to advance it. If you qualify, the employer job offer and labor certification are waived and you file the I-140 yourself. An advanced degree, patents or papers are only evidence and do not by themselves mean you qualify for NIW. The information below is current as of November 6, 2026.

First Threshold: EB-2 Eligibility

NIW is not a separate immigrant category but a waiver within EB-2. The applicant must first meet one of the following:

  • A U.S. master's degree or higher, or a foreign equivalent degree;
  • A U.S. bachelor's degree or foreign equivalent, plus 5 years of progressive post-baccalaureate professional experience;
  • Exceptional ability in the sciences, arts or business, meeting at least 3 of 6 regulatory criteria and showing a level of expertise significantly above that of peers.

For a comparison with employer sponsorship through PERM, see EB-2 lawyer: comparing PERM employer sponsorship and NIW.

Second Threshold: The Three-Part Test

USCIS assigns offices by Matter of Dhanasar (2016) framework:

  1. The endeavor has substantial merit and national importance. Explain specifically what you will do rather than saying in general terms that your industry is important. Importance is easier to show when the impact extends beyond a single employer or client.
  2. The applicant is well positioned to advance the endeavor. The officer looks at education, skills, past record, a specific plan, progress made and interest from users or funders.
  3. On balance, a waiver is beneficial to the United States. You need to explain why the United States would be better served by waiving the usual labor certification process.

Researchers, engineers, medical professionals and entrepreneurs may all evaluate this path, but the occupation itself does not decide the outcome. Weak points to watch for include an endeavor description that is too general, evidence that shows only past achievements, and recommendation letters that do not tie to objective evidence.

What to prepare

  • Degrees, transcripts and credential evaluations, and proof of work experience.
  • A description of the proposed endeavor: what you will do, where, who will benefit and your plans for the next several years.
  • Evidence of achievements: papers and citations, patents and their actual use, projects, funding, contracts and media coverage.
  • Objective materials showing impact, such as industry data and government reports.
  • Independent recommendation letters with specific facts.

NIW also requires submitting the relevant part of the labor certification form, with no Department of Labor approval needed; follow the I-140 instructions for the specific version.

Fees and Timing

The I-140 fee is $715 on paper and $665 online; self-petitioners pay an additional $300 Asylum Program Fee. NIW may pay $2,965 for premium processing, with a USCIS target time frame of 45 business days; premium processing affects only processing speed, not the standard of review.

Beginning in August 2026, when initial evidence is missing, an officer may deny a case without issuing a Request for Evidence, so your evidence needs to be complete at the first filing.

After Approval, There Is Still a Wait

An approved I-140 does not mean you have a green card. In the November 2026 Visa Bulletin, the EB-2 Final Action Date for people born in mainland China is October 1, 2021, and for most other regions it is April 1, 2025; the dates may change every month. After that, you proceed through Form I-485 or consular processing. A May 2026 USCIS memorandum (PM-602-0199) describes adjustment of status as exceptional discretionary relief, under which the officer looks at the status record and whether the person could have used consular processing instead; holding a dual-intent status also does not mean approval is certain. Evaluate this before filing the I-485.

FAQ

Does NIW need an employer?

No. If you qualify, the employer job offer and labor certification are waived and you file the I-140 yourself.

Does having an advanced degree or papers mean I qualify for NIW?

Not necessarily. An advanced degree, patents or papers are only evidence; you must still pass review under the three-part test.

Does an approved I-140 mean I have a green card?

No. An approved I-140 does not mean you have a green card. You must then look at the visa backlog and proceed through Form I-485 or consular processing.
